1. INTRODUCTION

By accessing the VivaAerobus internet site you agree to all the Terms and Conditions set forth herein. VivaAerobus expressly reserves the right to change and/or modify these Terms and Conditions at any time without any notice and/or liability whatsoever. The headings in these Terms and Conditions are for convenience of reference only and shall neither be deemed to be part of these Terms and Conditions nor modify, define, expand or limit any of the terms or provisions hereof. Any provision of these Terms and Conditions which is prohibited or unenforceable in any jurisdiction shall, as to such jurisdiction, be ineffective to the extent of such prohibition or unenforceability without invalidating the remaining provisions hereof, and any such prohibition or unenforceability in any jurisdiction shall not invalidate or render unenforceable such provision in any other jurisdiction.

2. DEFINITIONS

VivaAerobus: means Aeroenlaces Nacionales, S.A. de C.V.

Immediate Family Member: means any member of a family, whether by blood or by affinity, up to the second grade.

Minimum Wages: shall mean the basis for the calculation of indemnifications hereto and shall be equivalent to the minimum salary base on a daily basis valid in the Distrito Federal, on the date the damage occurred.

Personal Care Attendant: shall mean the VivaAerobus personnel or its respective, agents available to assist passengers with Special Needs.

Baggage: means all luggage, including suitcases, garment bags, tote bags, packages, camera and electronics bags, computer and equipment cases, briefcases and similar articles, whether carried by the Passenger in the cabin or carried in the aircraft cargo compartments. Coats and wraps, when carried by the Passenger in the Passenger cabin, will not be considered as Baggage.

Boarding Pass: means a document issued by Carrier entitled Boarding Pass bearing the Passenger’s first and last name, flight number and date, departure and destination airports, and a boarding group letter or number, which represents the Passenger’s boarding group. Boarding Passes may be obtained at vivaaerobus.com, or at the airport from Southwest at ticket counters.

Carriage: means the transportation of Passengers and/or Baggage by air, gratuitously or for hire, and all services of Carrier related thereto. Carrier: means Vivaaerobus and its officers, employees, contractors and agents acting in their official capacities.

Checked Baggage: means Baggage of which Carrier takes sole custody and for which Carrier has issued a Baggage Claim Check and affixed a Baggage Tag.

Flight Coupon: means the portion of the Passenger Ticket that is valid for Carriage.

Force Majeure Event: means any event outside of Carrier’s control, including, without limitation, meteorological events, such as storms, rain, wind, fire, fog, flooding, earthquakes, haze, or volcanic eruption. It also includes, without limitation, government action, disturbances or potentially volatile international conditions, civil commotions, riots, embargoes, wars, or hostilities, whether actual, threatened, or reported, strikes, work stoppage, slowdown, lockout or any other labor related dispute involving or affecting Carrier’s service, mechanical difficulties by entities other than Carrier, Air Traffic Control, the inability to obtain fuel, airport gates, labor, or landing facilities for the flight in question or any fact not reasonably foreseen, anticipated or predicted by Carrier.

Nonstop Flight: means a flight scheduled to operate between origin and destination airports without any intermediate stops.

One-way: means Scheduled Air Service on Carrier from an originating airport to a destination airport.

Passenger: means any person, except members of the Crew working on the flight, who is carried or will be carried in an aircraft with the consent of Carrier and is bound by this Contract of Carriage.

Roundtrip: means Scheduled Air Service on Carrier from an originating airport to a destination airport and back to the originating airport or carrier-recognized co-terminal.

Personal Electronic Devices: means mobile phones, CD or DVD players, mp3, Ipods, Ipads,laptop computers and any other equipment with wireless connection.

Prohibited Items: shall mean and include, without limitation, the following items on Checked-in Baggage:

Objects susceptible to risking the aircraft’s safety, the passengers or the goods on board of such aircraft, according to what’s declared by the Civil Aviation Law and its guidelines, Domestic and International air regulations and in the manuals and conditions of the same Airline. Here are some but are not limited to the following:

a. Flammable liquids or gasses (gasoline, paints, and gas refills)
b. Firearms or Explosives (Ammunition, fireworks, signal flares)
c. Industrial products or household goods (bleach, aerosols, mercury or solvents)
d. Matches or Lighters
e. Corrosive materials (acids, wet batteries, etc)
f. Hazardous materials or substances
g. Magnetized materials
h. Oxidizing materials (like peroxide)
i. Radioactive materials
j. Chemical substances
k. Portfolios or cases with alarm mechanisms installed
l. Venoms
m. Oxygen

For international flights, objects that are prohibited by the laws or regulations applicable to the country of departure or arrival will be also forbidden.

Objects that, to the Airlines discretion, could be dangerous or unsafe for the operation due to its weight, size or form, for which the Airline should take into account, among other things, the type of aircraft in use and if items are packed properly. Fragile or perishable objects, money, currency, jewelry, artwork, precious metals, silverware, securities and any other valuable objects such as expensive cloths, optic devices, electronics, televisions, computers, video and photo cameras, radio frequency transmitters, business documents, passports, and investment securities. The Airline will not be responsible for any lost, damaged or stolen articles mentioned above.

3. RESERVATIONS

a. Ticket and confirmation key The expedition of Tickets, or in its case, of the Confirmation Key, are fool proof of service contract and acceptance of all terms and conditions established in such contract, as well as the specific conditions of the hired service, such as flight date, schedule, origin and destination.

b. Cancelations Fares, Fees or Charges are non-refundable, save and except for the TUA, which shall be refundable but subject to the terms and conditions set forth by the airline and the respective Airport.

In exceptional circumstances, VivaAerobus will consider issuing a credit in the event of the bereavement of an Immediate Family Member, before the passenger has checked-in for the respective flight. In order to process the cancellation of your booking please contact your local VivaAerobus call centre. Before anybody can assist you in the flight cancellation process you will need to provide certified documents of the situation to support your refund request. If you have already started your journey, please contact your local VivaAerobus call centre who will try to assist you with making arrangements for your return journey.

c. Flight general conditions

All VivaAerobus fares are fully changeable in terms of number of flight, dates, times, routes and/or passenger names, up to 4 (four) hours prior to the original flight departure schedule.

1.1 Flight cancellation or oversold:

If a VivaAerobus flight is cancelled or oversold due to causes exclusively attributable to it and no suitable alternative flight is available pursuant to the Applicable Law, VivaAerobus will, upon proper application, offer a refund of all monies paid in respect of the unused portions of a flight according to the Applicable Law, without further liability. VivaAerobus does not provide compensation to customers for flights which are delayed or cancelled for reasons beyond VivaAerobus control. VivaAerobus strongly recommend passengers to ensure they have suitable private insurance cover in force to cover such eventualities.

1.2 Flight Connections:

VivaAerobus is strictly a point-to-point airline. Therefore we do not and cannot facilitate the transfer or connect passengers and/or their Baggage onto other flights, whether operated by VivaAerobus or other airline operators.

Passengers should therefore not book onwards or connecting flights with VivaAerobus or any other air or ground carrier. VivaAerobus accepts no responsibility for making connections and therefore will not be liable for any losses or expenses arising out of any failure to achieve a planned connection.

1.3 Non paid changes

If you make any changes to an existing reservation, including date changes, route changes, passengers name and add services and those changes are not paid on the time limit for the payment method selected, the reservation will be cancelled.

Fees paid and unused will be redeemed by issuing an electronic certificate which will be valid up to 30 days from the date issued. This certificate only covers the fare paid and the taxes associated; special services, administrative and transaction fees. The issuance of this electronic certificate will generate an administrative fee of $40 USD for each passenger in the reservation, this fee will be automatically deducted at the moment of the creation of the certificate.

d. Flight changes

1.1 Name change

Name of the passengers may be changed subject to a Change Name Fee. The Name Change Fee is $75 USD per name change if made through VivaAerobus internet web page:

www.VivaAerobus.com or $100 USD per name change if made through a VivaAerobus Call centre. Name changes must be made at least four hours prior to the schedule time for departure of the first flight in the booking and subject to call center opening hours. The same passenger name shall be used for all flights within the same booking.

1.2 Flight change

Flight time and date may be changed subject to availability and the payment of a Change Flight Fee. The Change Flight Fee is $50 USD per passenger if made through VivaAerobus internet web page: www.VivaAerobus.com or $80 USD per passenger if made through any other VivaAerobus sales desk or Call centre. Additionally the passenger must pay any upwards air Fare difference resulting at the moment of the itinerary change, as well of any service fee applicable at the moment of the transaction. If at the itinerary change results that the current air Fare is lower than the previously paid fare, the paid air fare will be maintained and no refund will be available.

1.3 Flight change by VivaAerobus

VivaAerobus may change a flight in its own and absolute discretion; provided however that, in the event of a schedule change VivaAerobus will endeavor to contact all passengers via the e-mail address supplied at time of booking. Notwithstanding the above, VivaAerobus strongly recommends that passengers reconfirm their flight booking prior to departure by reviewing their booking online.

If a VivaAerobus flight time is altered significantly (more than 3 (three) hours before or after the original scheduled departure time) and no suitable alternative flight is available, VivaAerobus, will upon application, offer a travel credit for all monies paid in respect of the time changed flight, without further liability

4. FARES

Fares shall apply for carriage of passengers and in certain cases to baggage, from the airport at the point of origin to the airport at the point of destination. Fares do not include ground transportation services to any airport and will be calculated in accordance with the Applicable Tariff.

a. Taxes

VivaAerobus shall have the right to charge to each passenger on behalf of the respective Airport, along with the air Fare, the TUA and the Security Charge and the passenger shall pay both charges to VivaAerobus together with the air Fare.

Fees, Taxes and Charges refer to that portion of the air Fare payable by each passenger to VivaAerobus and it is calculated by reference to the then current Government Taxes and Airport charges payable by VivaAerobus with respect to each passenger travelling on a particular route. In addition, Fees, Taxes and Charges may include Government charges, insurance surcharges, additional passenger or baggage security charges or other charges which may be imposed on the airline from time to time.

TUA: means the Use of Airport Tariff paid by the passenger to VivaAerobus on behalf of the airport. Security Charge: means a special charge paid by the passenger to VivaAerobus to cover for the airports services that include the security personnel services, luggage transportation services and check-points.

b. Transaction Fees:

A transaction fee will be applied and charged to each passenger when any payment is done with any form of cash or Credit Card, pursuant to the then applicable rate.

Customer Service Fee: All and each bookings made by VivaAerobus call centre or sales point are subject to a customer service fee of $26 USD Payment Fee: All and each bookings made by VivaAerobus are subject to a payment fee of $8 DLLS per passenger per flight.

c. Special services fees:

VIP pass + VivaExpress: This payment, allows a passenger to use de express line at the counter and be one of the first to board the aircraft, just before than any other group, once given the instructions by the airline personnel, allowing the passenger the option to choose the seat of his preference, the VIP pass + VivaExpress fee is $12.5 USD. In order to use this special service the passenger should follow the standard documentation process, by presenting himself two hours prior to the schedule departure on national flights and three hours prior when the purchased flight is international. The boarding pass will be marked with the initials VIP, which would serve to identify the Priority Boarding Pass. Additionally the passenger should be present at the boarding gate 30 minutes prior to the programmed departure and follow the airline personnel to board the aircraft.

This fee is non refundable and its subject to availability at the time of purchase or schedule change.

Boarding Group 1: This payment allows a passenger to board the Aircraft at the Group 1, the boarding group 1 fee is $7.5 USD. In order to use this special service the passenger should follow the standard documentation process, by presenting himself two hours prior to the schedule departure on national flights and three hours prior when the purchased flight is international. The boarding pass will be marked with the number 1, which would serve to identify the Group 1. Additionally the passenger should be present at the boarding gate 30 minutes prior to the programmed departure and follow the airline personnel to board the aircraft.

This fee is non refundable and its subject to availability at the time of purchase or schedule change.

Boarding Group 2: This payment allows a passenger to board the Aircraft at the Group 2, the boarding group 2 fee is $5 USD. In order to use this special service the passenger should follow the standard documentation process, by presenting himself two hours prior to the schedule departure on national flights and three hours prior when the purchased flight is international. The boarding pass will be marked with the number 2, which would serve to identify the Group 2. Additionally the passenger should be present at the boarding gate 30 minutes prior to the programmed departure and follow the airline personnel to board the aircraft.

This fee is non refundable and its subject to availability at the time of purchase or schedule change.

Boarding Group 3: This payment allows a passenger to board the Aircraft at the Group 3, the boarding group 3 fee is $3.5 USD. In order to use this special service the passenger should follow the standard documentation process, by presenting himself two hours prior to the schedule departure on national flights and three hours prior when the purchased flight is international. The boarding pass will be marked with the number 3, which would serve to identify the Group 3. Additionally the passenger should be present at the boarding gate 30 minutes prior to the programmed departure and follow the airline personnel to board the aircraft.

This fee is non refundable and its subject to availability at the time of purchase or schedule change.

Boarding Group 4: This payment allows a passenger to board the Aircraft at the Group 4, the boarding group 4 has no fee.

In order to use this special service the passenger should follow the standard documentation process, by presenting himself two hours prior to the schedule departure on national flights and three hours prior when the purchased flight is international. The boarding pass will be marked with the number 4, which would serve to identify the Group 4.

Additionally the passenger should be present at the boarding gate 30 minutes prior to the programmed departure and follow the airline personnel to board the aircraft.

Upgrade weight from 25kg (55 Lbs) to 32kg (70 Lbs): This payment allows a passenger to upgrade weight from the original baggage of 25kg (55 Lbs) to 32kg (70 Lbs), the upgrade fee is $20 USD; this service is only available by web www.vivaaerobus.com or by our Call centre.

Extra bag 15kg (33 Lbs): This payment allows a passenger to take an extra bag from 15kg (33 Lbs) the extra bag 15kg fee is $20 USD; this fee is only available by web www.vivaaerobus.com or by our Call centre. The fee at the airport is $48 USD.

Extra bag 32kg (70 Lbs): This payment allows a passenger to take an extra bag from 32kg (70 Lbs) the extra bag 32kg fee is $40 USD; this fee is only available by web www.vivaaerobus.com or by our Call centre. The fee will not be available at the airport.

Vivapremium: This payment allows a passenger to upgrade weight from the original baggage of 25kg (55 Lbs) to 32kg (70 Lbs) and take an extra bag from 32kg (70 Lbs) the extra bag 32kg fee is $45 USD; this fee is only available by web www.vivaaerobus.com or by our Call centre. The fee will not be available at the airport.

Sporting Goods or Musical instruments transportation: Any of the items listed below may be checked as an sporting or musical goods one piece will be allowed for each Passenger whit an extra fee of $27.7 USD; this fee is only available by web www.vivaaerobus.com or by our Call centre. The fee at the airport is $58 USD.

Archery equipment: including a bow, arrows, and an average size target (large target stands cannot be accepted), so long as the bow and arrows are encased in a container acceptable to Carrier for withstanding normal Baggage handling without sustaining damage to the equipment.

Bowling bag: including ball(s) and shoes.

Bicycles: (defined as no motorized and having a single seat) properly packed in a hard-sided bicycle box that fall within the dimensions and weight limits established for normal Checked Baggage, (i.e., 62 inches or less in overall dimensions and less than 50 pounds in weight). Pedals and handlebars must be removed and packaged in protective materials so as not to be damaged by or cause damage to other Baggage. Bicycles packaged in cardboard or soft-sided cases will be transported as conditionally accepted items.

Fishing tackle box and fishing rod: so long as the rod is encased in a cylindrical fishing rod container suitable to Carrier as Checked Baggage.

Golf bag: in hard-sided golf bag carrying case provided by Passenger, including clubs, balls, and shoes. (Hooded golf bags or golf bags in a soft-sided carrying case provided by the Passenger will be conditionally accepted).

Scuba equipment: provided air tanks are empty and all accompanying equipment (e.g., BCD, weight belt, one regulator, one tank harness, one tank pressure gauge, one mask, two fins, one snorkel, one knife, and one safety vest) are encased together in a container acceptable to Carrier.

Hockey and/or lacrosse stick(s): as long as multiple sticks are either taped together or encased in a suitable bag or container.

Javelins: For purposes of this provision, Javelins encased in hard side containers and taped together as one piece will be considered as one item of sporting equipment.

Kayaks: VivaAerobus will not transport Kayaks

Oars: For purposes of this provision, one pair of oars or one oar case containing up to two oars will be considered as one item of sporting equipment.

Water Skiing/Snow Skiing/Snowboard Equipment: for purposes of this provision, one snowboard, one snowboard bag containing up to two snowboards or one ski bag containing up to two pairs of skis and associated equipment and one ski boot bag will be considered as one item of sporting equipment.

Baseball equipment: will be accepted in the normal baggage allowance in lieu of a piece of baggage. One item of baseball equipment consists of: 10 bats, helmet, uniform, cleats, batting gloves, glove, catcher will have additional equipment (padding, mask, etc.)

Surf Equipment: Surf equipment not exceeding 70 pounds/115 inches in length will be accepted as Checked Baggage. For purposes of this provision, one surfboard, wakeboard, wave ski, kiteboard or one surfboard bag weighing up to 50 lbs. will be considered as one item of surf equipment.

Windsurfing Equipment: Windsurfing boards will be accepted as Checked Baggage. For purposes of this provision, one windsurfing board not exceeding 115 inches in length and not exceeding 70 pounds (31.8kgs) with a boom and one mast and sail will be considered as one item of windsurfing equipment; windsurfing equipment must be padded and enclosed in suitable packing to protect from scratches, dents or other damage resulting from normal handling.

Camping Equipment: the camping equipment includes: tents, backpacks and sleeping bags, thee should not exceed 319 linear inches and 70 pounds.

VivaAerobus will accept to checked the follow musical instruments, we recommend to bring musical instruments as checked baggage as long as they fit within the size and weight limitations of the airline. We encourage you to stay with your instrument while security officers screen it to make sure it is repacked properly.

Accordion: 1 accordion properly packaged in a suitable container and whose dimensions should not exceed 319 linear inches and 70 pounds

Harps: VivaAerobus will not transport harps

Batteries: 1 battery per passenger, battery should be properly packaged in one or more containers, dimensions should not exceed 319 linear inches and 70 pounds. There will be an individual charge per container.

Drums: a pair of drums per passenger will be accepted; small pump can be placed in overhead bins or under the seat and can be carried as hand luggage without change.

Bongos: a pair of bongos per passenger packaged in a suitable container, dimensions should not exceed 319 linear inches and 70 pounds.

Bass: one bass per passenger properly packaged in a suitable container and whose dimensions do not exceed 319 linear inches and 70 pounds.

Guitar: one guitar properly packaged in a suitable container and dimensions do not exceed 319 linear inches and 70 pounds. Spanish guitars and other small guitars, although they can be placed in overhead bins or under the seat will be considered as a musical instrument so the corresponding charges apply.

Piano: VivaAerobus will not transport pianos.

Saxophone: a saxophone per passenger will be accepted in a suitable container and dimensions do not exceed 319 linear inches and 70 pounds.

Keyboards: a keyboard per passenger will be accepted properly packaged in a suitable container and whose dimensions do not exceed 319 linear inches and 70 pounds.

Trombone: a trombone per passenger will be accepted properly packaged in a suitable container and whose dimensions do not exceed 319 linear inches and 70 pounds.

Cello: a cello per passenger will be accepted properly packaged in a suitable container and whose dimensions do not exceed 319 linear inches and 70 pounds.

Other instruments

The following instruments may be included in the free baggage allowance, either carry on or document luggage: harmonic, castanets, cowbell, clarinet, keys, crotalus, bassoon, flute, lute, tambourine, cymbals, violin.

This list is not exhaustive, small musical instruments that can be placed in overhead bins or under the seat may be transported as piece of hand luggage free of charge.

Pets transportation: VivaAerobus allows transport dogs and/or cats within the aircraft cargo compartments. The pet transportation fee is $83 USD per domestic flight and $108 USD on international flights. This makes if necessary to consider the following conditions:

1. Pets will be accepted only on direct flights on the same day to operate the flight.

2. The pets transportation is subject to availability of space in the cargo compartments.

3. For the pet documentation, passenger must make the check in 2 hours before the flight; the pet must be inside of a rigid pet carrier provided by the passenger The carriers must be leak-proof and well-ventilated, and the pet(s) must be able to stand up and move around the carrier with ease.

4. On International flights pets requires health certificate issued by SAGARPA.

5. VivaAerobus is not responsible for the feeding and care of the pets.

6. VivaAerobus is not responsible in case of injury, illness or death resulting from transportation.

7. The number of animals to be transported is limited to three (3) by flight; considering measure of carriers, temperature and duration of the flight.

8. The maximum weight per pet, including the pet carrier, should not exceed 70 pounds and 319 linear inches.

5. PAYMENTS

All reservations made through Vivaaerobus are purchased and immediate paid. We offer the option to charge your Visa or Master Card credit cards or by csh settlement at any Banamex bank.

On credit card charges, all transactions are final, so any future changes will be subject to applicable charges and new fees as well as the availability of seats. All Vivaaerobus fees are non-refundable.

If payment is made thought Banamex bank, a time limit will be assigned to the reservation, if payment is not made within the time limit set, the reservations will be cancelled in its entirety.

* Charging by credit or debit card thought Callcenter By paying for the reservation thought the Callcenter if the cardholder is one of the passengers who fly should meet the following requirements:

- Having reservation code (6 letters)
- Having photo ID (IFE, military ID, Passport, Visa or professional license).
- The cardholder must present documentation to the counter the day of your flight with the credit/debit card (physical). We do not accept other credit cards than the one used in the original purchase.

NOTE: If the card holder does not meet the above requirements will be denied boarding without exception.

By paying for the reservation thought the Callcenter if the cardholder is not one of the passengers who fly should meet the following requirements:

- Having reservation code (6 letters)
- Having photo ID (IFE, military ID, Passport, Visa or professional license)
- The cardholder must be submitted along with the passenger traveling on counters on the day ofe your flight with the credit/debit card (physical). We do not accept other credit cards than the one used in the original purchase.

NOTE: If the card holder does not meet the above requirements will be denied boarding without exception.

IMPORTANT NOTE: Vivaaerobus also informs you that the same terms and conditions described above for payment by credit/debit card will be applied equally to movements such as: name change, itinerary change and adding special services.

6. CHECK IN

a. Passenger Check in requirements Passengers should present themselves at the appropriate VivaAerobus check-in counter, with an official identification and the payment confirmation.

b. Recommended Check in times VivaAerobus check-in counter will open two hours prior to the scheduled time of departure. Check-in counter desks close promptly 45 (forty five) minutes before the scheduled time of departure. Passengers who present themselves to the check-in counter later than 45 (forty five) minutes prior to the scheduled time of departure will not be accepted for travel. VivaAerobus reserves the right to cancel the passenger’s reservation and deny the passengers boarding if they do not comply with the check-in deadlines and departure formalities.

c. Online Check in This is an optional service available only for the Vivaregular passengers you can print your boarding pass online from 72 hours to 4 hours before departure of the flight original schedule. You must present this boarding pass, accompanied by an official identification as listed in the terms and conditions, at the point of airport security and the boarding gate.

Once you print the boarding pass, no changes of name or flight itinerary will be allowed.
Failure to present your boarding pass at security checkpoints in the airpor, shall go to the counters to print you one. In this case some charges may apply. If you have printed online boarding pass and is forgotten or lost, the passenger must to the counters to print you one and pay an extra charge for reprint boarding pass of $ 38 USD.

IMPORTANT: The counters close 45 minutes documentation prior to departure time. Vivaaerobus is not responsible for lost of your flight if you do not bring your boarding pass and not come before the closure of counters. At some stations you pass counters requested to review the weight and the amount of your baggage.

NOTE: Passengers forced to check in over the counter are:

a) Pregnant passengers and/or persons who have undergone surgery recently.
b) Unaccompanied minors
c) Persons traveling with special luggage
d) Passengers with disabilities or passengers that require support to use crutches, wheelchairs, etc.
e) Persons traveling with pets

If you are vivalight passenger and your carry on luggage exceeds the specifications, you must pay $48 USD for each route where the luggage do not adhere to the discount specifications.

Passengers must report to the boarding gate 30 minutes before departure time of the flight.

NOTE: Vivaaerobus reserves the right to cancel your reservation without refund and/or deny boarding if passenger arrives late at the boarding gate or if baggage exceeds the maximum weight or dimensions of it.

7. BAGGAGE

a. Baggage general conditions Passengers and their baggage will be subjected to security screening throughout their journey with VivaAerobus. In order to assist VivaAerobus with this requirement, each passenger shall ensure their cabin baggage is packed in such a way that, if requested by airport or airline personnel, including security personnel, at check-in, each passenger is able to transfer items into bags which are to be checked-in. Each passenger is permitted to carry two pieces of hand baggage into the aircraft cabin, weighing up to 10 kg (22 Lbs). Infants who share a seat do not have a baggage allowance.

Passenger must identify their checked baggage with their name, address and contact telephone numbers and/or their flight confirmation number. Failure to comply with this simple requirement may result in a significant delay in the tracing of your checked baggage should it become lost or misplaced. VivaAerobus shall have no liability whatsoever for cosmetic and/or superficial damage caused to baggage as a result of normal wear and tear during the course of carriage. Baby buggies, cots and car seats are also considered to be inherently unsuitable for carriage by air. VivaAerobus is prepared to carry such items on a limited basis (i.e. entirely at your own risk for damage or delay). All passengers shall therefore ensure to have suitable private insurance coverage in force for such items.

b. Carry on baggage

Each passenger is permitted to carry two pieces of hand baggage into the aircraft cabin, weighing up to 10 kg (22 Lbs). Infants who share a seat do not have a baggage allowance.

Passengers who choose vivalight service, be granted whit a discount of $ 10 USD from the regular rate; whit vivalight discount, you are force to travel only with hand luggage. Passengers are allowed to carry only two bags of luggage per passenger, weighing combined total of 22 Lbs with maximum dimensions of 55 (fifty five) cm x 40 (forty) cm x 20 (twenty) inches. If the passenge for any reason or circumstance decides to arrive at the airport with a checked suitcase or hand luggage that exceeds the terms of weight and size and have booked their flights with discount vivalight, the passenger will lose the discount, which must be repaid additional airport whit the fees applicable.

If the passenger is not interested in booking your flight with the discount vivalight, according to the terms and conditions mentioned, the passenger will select the regular rate of VivaAerobus (live regular). This fee allows passengers to travel with two pieces of hand baggage per passenger with a combined weight of 10 (ten) kilos with maximum dimensions of 55 (fifty five) cm x 40 (forty) cm x 20 (twenty) centimeters .

Personal pieces any bag, small backpack, diaper bag or laptop bag, will be considered also as carry on baggage.

c. Prohibited items

Shall mean and include, without limitation, the following items on Checked-in Baggage:

Objects susceptible to risking the aircraft’s safety, the passengers or the goods on board of such aircraft, according to what’s declared by the Civil Aviation Law and its guidelines, Domestic and International air regulations and in the manuals and conditions of the same Airline. Here are some but are not limited to the following:

a. Flammable liquids or gasses (gasoline, paints, and gas refills)
b. Firearms or Explosives (Ammunition, fireworks, signal flares)
c. Industrial products or household goods (bleach, aerosols, mercury or solvents)
d. Matches or Lighters
e. Corrosive materials (acids, wet batteries, etc)
f. Hazardous materials or substances
g. Magnetized materials
h. Oxidizing materials (like peroxide)
i. Radioactive materials
j. Chemical substances
k. Portfolios or cases with alarm mechanisms installed
l. Venoms
m. Oxygen

For international flights, objects that are prohibited by the laws or regulations applicable to the country of departure or arrival will be also forbidden.

Objects that, to the Airlines discretion, could be dangerous or unsafe for the operation due to its weight, size or form, for which the Airline should take into account, among other things, the type of aircraft in use and if items are packed properly.

Fragile or perishable objects, money, currency, jewelry, artwork, precious metals, silverware, securities and any other valuable objects such as expensive cloths, optic devices, electronics, televisions, computers, video and photo cameras, radio frequency transmitters, business documents, passports, and investment securities. The Airline will not be responsible for any lost, damaged or stolen articles mentioned above.

d. Sporting and musical goods transportation Any of the items listed below may be checked as sporting or musical goods one piece will be allowed for each Passenger whit an extra fee of $27.7 USD; this fee is only available by web www.vivaaerobus.com or by our Call centre. The fee at the airport is $58 USD.

Archery equipment: including a bow, arrows, and an average size target (large target stands cannot be accepted), so long as the bow and arrows are encased in a container acceptable to Carrier for withstanding normal Baggage handling without sustaining damage to the equipment.

Bowling bag: including ball(s) and shoes.

Bicycles: (defined as no motorized and having a single seat) properly packed in a hard-sided bicycle box that fall within the dimensions and weight limits established for normal Checked Baggage, (i.e., 62 inches or less in overall dimensions and less than 50 pounds in weight). Pedals and handlebars must be removed and packaged in protective materials so as not to be damaged by or cause damage to other Baggage. Bicycles packaged in cardboard or soft-sided cases will be transported as conditionally accepted items.

Fishing tackle box and fishing rod: so long as the rod is encased in a cylindrical fishing rod container suitable to Carrier as Checked Baggage.

Golf bag: in hard-sided golf bag carrying case provided by Passenger, including clubs, balls, and shoes. (Hooded golf bags or golf bags in a soft-sided carrying case provided by the Passenger will be conditionally accepted).

Scuba equipment: provided air tanks are empty and all accompanying equipment (e.g., BCD, weight belt, one regulator, one tank harness, one tank pressure gauge, one mask, two fins, one snorkel, one knife, and one safety vest) are encased together in a container acceptable to Carrier. Hockey and/or lacrosse stick(s): as long as multiple sticks are either taped together or encased in a suitable bag or container.

Javelins: For purposes of this provision, Javelins encased in hard side containers and taped together as one piece will be considered as one item of sporting equipment.

Kayaks: VivaAerobus will not transport Kayaks Oars: For purposes of this provision, one pair of oars or one oar case containing up to two oars will be considered as one item of sporting equipment.

Water Skiing/Snow Skiing/Snowboard Equipment: for purposes of this provision, one snowboard, one snowboard bag containing up to two snowboards or one ski bag containing up to two pairs of skis and associated equipment and one ski boot bag will be considered as one item of sporting equipment.

Baseball equipment: will be accepted in the normal baggage allowance in lieu of a piece of baggage. One item of baseball equipment consists of: 10 bats, helmet, uniform, cleats, batting gloves, glove, catcher will have additional equipment (padding, mask, etc.)

Surf Equipment: Surf equipment not exceeding 70 pounds/115 inches in length will be accepted as Checked Baggage. For purposes of this provision, one surfboard, wakeboard, wave ski, kiteboard or one surfboard bag weighing up to 50 lbs. will be considered as one item of surf equipment.

Windsurfing Equipment: Windsurfing boards will be accepted as Checked Baggage. For purposes of this provision, one windsurfing board not exceeding 115 inches in length and not exceeding 70 pounds (31.8kgs) with a boom and one mast and sail will be considered as one item of windsurfing equipment; windsurfing equipment must be padded and enclosed in suitable packing to protect from scratches, dents or other damage resulting from normal handling.

Camping Equipment: the camping equipment includes: tents, backpacks and sleeping bags, thee should not exceed 319 linear inches and 70 pounds.

VivaAerobus will accept to checked the follow musical instruments, we recommend to bring musical instruments as checked baggage as long as they fit within the size and weight limitations of the airline. We encourage you to stay with your instrument while security officers screen it to make sure it is repacked properly.

Accordion: 1 accordion properly packaged in a suitable container and whose dimensions should not exceed 319 linear inches and 70 pounds.

Harps: VivaAerobus will not transport harps.

Batteries: 1 battery per passenger, battery should be properly packaged in one or more containers, dimensions should not exceed 319 linear inches and 70 pounds. There will be an individual charge per container.

Drums: a pair of drums per passenger will be accepted, small pump can be placed in overhead bins or under the seat and can be carried as hand luggage without change Bongos: a pair of bongos per passenger packaged in a suitable container, dimensions should not exceed 319 linear inches and 70 pounds.

Bass: one bass per passenger properly packaged in a suitable container and whose dimensions do not exceed 319 linear inches and 70 pounds.

Guitar: one guitar properly packaged in a suitable container and dimensions do not exceed 319 linear inches and 70 pounds. Spanish guitars and other small guitars, although they can be placed in overhead bins or under the seat will be considered as a musical instrument so the corresponding charges apply.

Piano: VivaAerobus will not transport pianos.

Saxophone: a saxophone per passenger will be accepted in a suitable container and dimensions do not exceed 319 linear inches and 70 pounds.

Keyboards: a keyboard per passenger will be accepted properly packaged in a suitable container and whose dimensions do not exceed 319 linear inches and 70 pounds. Trombone: a trombone per passenger will be accepted properly packaged in a suitable container and whose dimensions do not exceed 319 linear inches and 70 pounds.

Cello: a cello per passenger will be accepted properly packaged in a suitable container and whose dimensions do not exceed 319 linear inches and 70 pounds.

Other instruments: The following instruments may be included in the free baggage allowance, either carry on or document luggage: harmonic, castanets, cowbell, clarinet, keys, crotalus, bassoon, flute, lute, tambourine, cymbals, violin.

This list is not exhaustive, small musical instruments that can be placed in overhead bins or under the seat may be transported as piece of hand luggage free of charge.

e. Animals or pets transportation

VivaAerobus allows transport dogs and/or cats within the aircraft cargo compartments. The pet transportation fee is $83 USD per domestic flight and $108 USD on international flights. This makes if necessary to consider the following conditions:

1. Pets will be accepted only on direct flights on the same day to operate the flight.
2. The pets transportation is subject to availability of space in the cargo compartments.
3. For the pet documentation, passenger must make the check in 2 hours before the flight; the pet must be inside of a rigid pet carrier provided by the passenger The carriers must be leak-proof and well-ventilated, and the pet(s) must be able to stand up and move around the carrier with ease.
4. On International flights pets requires health certificate issued by SAGARPA.
5. VivaAerobus is not responsible for the feeding and care of the pets.
6. VivaAerobus is not responsible in case of injury, illness or death resulting from transportation.
7. The number of animals to be transported is limited to three (3) by flight; considering measure of carriers, temperature and duration of the flight.
8. The maximum weight per pet, including the pet carrier, should not exceed 70 pounds and 319 linear inches.

f. Personal Human Transporter

One Personal Human Transporter will be transported in lieu of one piece of Checked Baggage, if aircraft size and load conditions permitted.

g. Human remains transportation

VivaAerobus does not accept human remains for carriage on any routes.

The carriage of ashes is permitted. Passengers must ensure that the ashes are reported either at the check-in counter or at the departure gate and are packaged in a secure suitable container. Ashes may only be carried as hand baggage (and will be accepted in addition to your one piece of cabin baggage). Please ensure that the urn/casket has a secure screw top/lid.

Passengers wishing to carry ashes are advised to call our call center, to that we can ensure all the relevant handling agents are advised.

8. ACCEPTANCE OF PASSENGER

a. Children, Minors and Infants

VivaAerobus does not carry unaccompanied minors (children under 14 (fourteen) years old). Escort and special facilities are not available. VivaAerobus will carry young persons aged 14 (fourteen) to 17 (seventeen) years only upon completion and signature of the Form of Indemnity at check-in point of each departure airport by both of its parents or legal custodian. Young persons aged 14 (fourteen) to 17 (seventeen) years old travelling on VivaAerobus must present the required photo identification at check-in (passport or school ID). On International flights passport is required. The parents or legal custodian of the young person are required to remain in the airport until the flight has departed. Children under the age of 14 (fourteen) must always be accompanied on the same reservation by a passenger over 18 (eighteen) years old, who is a parent or legal custodian.

For safety reasons infants must be over 8 (eight) days old before they are permitted to travel on VivaAerobus flights.

Children aged between 8 (eight) days and 2 (two) years at the date of travel cannot travel in their own seat and must sit on an adult’s lap. The charge for carriage of infants is $35 USD per one way trip and $70 USD per round trip (maximum one infant per adult). No baby car seats are allowed in the cabin of the aircraft. No extra seats may be booked for infants. Infants do not qualify for a baggage allowance. If the infant reaches the age of 2 (two) years prior to the return flights, he shall be subject to pay the applicable Fare, Taxes, Fees and Charges for that part of the journey. Proof of age may be required, it is advisable to have a valid photo identification of the infant (passport or birth certificate) and be prepared for inspection.

Undeclared infants has an extra fee of $30USD, the rate on one way trip will be $65 USD and $100 USD on round trip, payment fees will apply.

b. Passengers with disabilities

For safety reasons VivaAerobus can carry a maximum of 2 (two) passengers per Domestic flight and a maximum of 4 (four) passengers per International flight who have either reduced mobility, blind or visually impaired, travelling with a guide dog or alone who require special assistance at the airport. Such passengers (including in the case of those who are blind or visually impaired, if travelling with sighted companion) must notify VivaAerobus of their condition or special requirements on the day of booking via the local VivaAerobus call center, but always at least four hours before check-in. Failure to notify VivaAerobus will result in the service being unavailable to the passenger upon their arrival at the airport and them being refused carriage.

In accordance with VivaAerobus own safety programs and to ensure that VivaAerobus is pre-advised of any and all passengers physical condition and/or their special needs or assistance, VivaAerobus has listed the options for passengers with special needs or assistance, available at its flights, below. Each passenger shall advise VivaAerobus call center when making the reservation, the election of any available option as listed below.

a) WCHR: Passenger who requires the use of an airport wheelchair and to be pushed through the airport terminal to the steps of the aircraft.

b) WCHS: Passenger who requires the use of an airport wheelchair and to be pushed through the airport terminal to the steps of the aircraft and also requires lift on/lift off assistance onto and off the aircraft.

c) WCHR: Passenger who requires the use of an airport wheelchair only but does not require to be pushed by airport staff.

d) WCHS: Passenger not traveling in a wheelchair that requires no assistance through the airport to the aircraft but does require lift on / lift off assistance onto the aircraft.

e) WCHR: Passenger traveling in their own wheelchair that only requires to be pushed through the airport terminal to aircraft steps; f) WCHC: Passenger traveling in their own wheelchair that requires to be pushed through the airport terminal to aircraft steps and also require lift on/ lift off assistance onto the aircraft.

g) WCHR: Passenger traveling in their own wheelchair that does not require to be pushed through the airport terminal to the aircraft steps, but does require lift on/lift off assistance onto and off the aircraft.

h) WCHR: Passenger traveling in their own wheelchair that requires no assistance at all from airport staff.

i) Blind or vision impaired passenger traveling alone without a sighted companion that requires a walker to and from the terminal to the aircraft.

j) Blind or vision impaired passenger traveling with a guide dog and requires a walker to and from the terminal to the aircraft.

k) Blind or vision impaired passenger traveling alone without a sighted companion and requires no assistance.

l) Blind or vision impaired passenger traveling with a guide dog and requires no assistance.

m) Blind or vision impaired passenger traveling with a sighted companion and requires no assistance.

n) Passenger with an intellectual disability: who is able to understand and respond appropriately to safety instructions and does not require a Personal Care Attendant, but does require a walker to and from the terminal to the aircraft.
All passengers travelling with broken limbs in plaster are required to travel with a medical certificate confirming their fitness to travel. Passengers travelling with upper limbs in cast (waist and above) will only require one seat to travel. Adult passengers travelling with lower limbs in cast, waist and/or full leg plaster, must purchase three seats in total per flight, to travel. This will enable the leg to be elevated during the flight and reduce swelling. Passengers travelling with lower leg in plaster (below the knee only), will only require one seat. Child passengers travelling with lower limbs in cast will be dealt with as above, but the length of the cast will need to be determined to decide whether they require one or more seats to enable their leg to be elevated during the flight, passengers should contact their local Vivaaerobus call center for further assistance.

c. Pregnant passengers

Vivaaerobus will accept pregnant women for travel up to 27 (twenty seven) weeks (inclusive) without a medical certificate. When traveling between 28 (twenty eight) and 36 (thirty six) weeks (inclusive), a medical certificate issued by a doctor will be required confirming the number of weeks of pregnancy and confirming the passenger is fit to fly. All return flights must be completed not later than week number 36 (thirty six) of the pregnancy. It is the responsibility of all pregnant women to advise Vivaaerobus of their condition at the time of reservation and check-in.

d. Medical Syringes

For health reasons, passengers need to inject themselves during the flight (e.g. diabetics), they are permitted to carry syringes in the cabin. They will be asked to produce appropriate medical evidence (a letter from the doctor will suffice) when they check-in or at the security screening check-point. The passenger shall kept this letter and be ready to show it, at all times

e. Infectious diseases

Passengers suffering infectious diseases, for example, respiratory infections or tuberculosis, are not permitted to fly on Vivaaerobus flights, without exception.

Passengers with rubella can be accepted 4 days after symptom onset, passengers with measles or chickenpox may be accepted 7 days after symptoms appear. All passengers traveling whit any of the conditions listed above, must have a medical certificate confirming they are fit to fly.

f. Allergies

All passengers are advised that VivaAerobus may sell products on board, like peanuts, which may seriously affect allergic passengers; therefore, VivaAerobus disclaims any responsibility to that effect.

g. Stretches:

VivaAerobus does not accept stretches for carriage on any flights.

9. CONDITIONS OF SERVICE

a. Suspension of Services:
Pursuant to the Applicable Aviation Law and Regulations, VivaAerobus may suspend the rendering of all of its scheduled flights without prior notice, for causes beyond its control, without any further responsibility and/or liability.

b. Refusal
VivaAerobus can refuse carriage of any passenger or offload them at any airport if VivaAerobus, at its absolute discretion, considers that:

a) such action is necessary for reasons of security to its passengers, aircraft, equipment, employees or cargo; or

b) such action is necessary in order to comply with any applicable laws, regulations or orders of any state or country to be flown from, into or over; or

c) The passengers conduct, status, age or mental or physical condition or the physical condition of the passenger Baggage is such as to:

* require special assistance (save where the “Special Needs” provisions of our Carrier’s Regulations apply); or

* may cause harm and/or discomfort to other passengers or crew; or

* involve any hazard or risk to themselves or other persons or to property.

d) the passenger has committed misconduct on a previous Flight; or

e) the passenger has not observed, VivaAerobus instructions with respect to safety or security; or

f) the passenger has refused to submit to a security check; or

g) the applicable fare or any charges or taxes payable have not been paid, or credit arrangements agreed between the airline and the passenger (or the person paying the Fare) have not been complied with; or

h) the passenger does not appear to be properly documented; or

i) any of the required documentation presented by the passenger:

* has been acquired unlawfully or has been purchased from an entity other than VivaAerobus or its authorized agents; or

* has been reported as being lost or stolen; or

* is counterfeit; or

* has been altered or mutilated (in which case VivaAerobus reserve the right to retain such documentation).

j) The person presenting for check-in or boarding cannot prove that they are the person named as the Passenger on the Ticket (in which case VivaAerobus reserve the right to retain such Ticket).

c. Smoking:

Passengers are not permitted to smoke in any part of a VivaAerobus aircraft. Failure to obey this regulation will result in a criminal prosecution being brought against the passenger. VivaAerobus will claim any disruption and/or damage costs that arise as a result of the passenger smoking incident.

d. Mobile Phones:

Mobile phones and Personal Electronic Devices equipped with wireless phone connections may be carried only in cabin baggage but must be switched off once the aircraft doors are closed for departure or when instructed so by the aircraft crew members. These items must not be used during flight.
